A Cumnock man has been placed on the sex offenders register after touching a woman's buttocks during a Hogmanay event at a local hotel.

John McSeveny was also given unpaid work after expressing 'remorse and regret' for the sexual assault at the Royal Hotel.

The 56-year-old was found guilty at a trial at Ayr Sheriff Court  of sexually assaulting the complainer at the venue in Glaisnock Street on December 31, 2023 after touching her on the buttocks.

Sentence was deferred to allow social workers time to prepare a background report.

When he returned to court for sentencing, defence solicitor John Gallagher said: “The matter proceeded to trial and Mr McSeveny has considered the terms of the [social work] report. 

“He wishes to make very clear, whatever the conclusions about his own circumstances [in the report], that he appreciates how upsetting the incident was for complainer.

"He is extremely remorseful and regretful. 

"While he accepts there may have been contact, it was not intentional. 

"He has one matter on his record and has nothing else outstanding.

"He is regretful he now has this stain on his character."

Sheriff Maria Kicinski said: "I have listened, obviously, to the trial, and have read what the report says of your behaviour.

"I accept your remorse for the matter.  

“I’m going to impose a community payback order with a supervision requirement for six months."

Sheriff Kicinski also ordered McSeveny, of Oakbank Drive, Holmhead, to carry out 40 hours of unpaid work in the community by March of next year.

In addition, his name was added to the sex offenders register for the same length of time and will be subject to all the requirements of the register.

The sheriff reminded McSeveny: “To be clear, notify police of any change to your name or address.”
